1. Acceptance and related policies

These Terms govern access to https://tools.medibridgeasia.tech/medilinkwebsite and its public pages, forms and E-Market functionality. By using the relevant service, you agree to these Terms. If you do not agree, do not use it.

The Privacy Policy, Website Disclaimer, Shipping & Delivery Policy and Refund & Return Policy form part of these Terms where relevant. Separate portals, applications, customer services and contracts may have additional terms; those specific terms prevail for the relevant service if inconsistent.

If you use the Website for an organisation, you confirm that you are authorised to act for it. A person under 18 may use transactional functions only with the involvement and consent of a parent or legal guardian.

2. Permitted use

Use the Website only for lawful personal or legitimate business purposes and provide accurate, current and complete information.

You must not gain or attempt unauthorised access; interfere with availability or security; introduce malicious code; evade controls; overload services; impersonate another person; submit false, infringing or unlawful material; scrape protected content; reverse engineer except where law permits; or use the Website to harm a person or violate rights.

Automated access, data extraction, security testing or integration requires prior written permission unless expressly allowed by law. We may apply rate limits and security controls.

3. Accounts, portals and security

Where an account is provided, keep credentials confidential, use required multi-factor authentication and notify the relevant support channel promptly of suspected compromise. You are responsible for activity authorised through your account until access is reported and reasonably disabled, subject to applicable law.

Member, corporate, provider and physician portals may be operated under separate access rules, privacy notices and customer contracts. A public Website link does not make those portals part of the E-Market terms.

4. Healthcare and product information

General health, wellness, provider, claims and benefits content is informational only and is subject to the Website Disclaimer. It is not medical advice, an emergency service, a claim approval or a guarantee of eligibility, coverage, provider status or outcome.

Product descriptions, images, availability and specifications are prepared with reasonable care but may change. Follow manufacturer labels and warnings and seek qualified advice where appropriate.

5. Enquiries, quotations and provider applications

A Contact Us, Request for Quotation or panel-provider submission is a request for review, not acceptance of business, appointment to a panel, approval of credentials or a binding contract.

You confirm that submitted information is accurate, lawful and that you are authorised to provide any personal data or document. We may request verification and may decline, pause or close a request where information is incomplete, risk is unacceptable or we cannot lawfully proceed.

6. E-Market availability

E-Market functions may be unpublished, restricted or disabled. When E-Market is unavailable, product content is not an invitation to submit payment and no order can be placed through the Website.

When ordering is enabled, the product page, checkout or order confirmation will state the main product characteristics, full price or method of calculation, payment method, relevant terms and estimated delivery information required for the transaction.

7. Ordering process and correction of errors

Before confirming an online order, you will have an opportunity to review and correct input errors. After submission, we will acknowledge receipt without undue delay. An acknowledgement confirms receipt only and is not acceptance unless it expressly says so.

An order is accepted only when we send an express order confirmation or dispatch notice, as stated in the checkout flow. We may verify identity, authority, stock, price, delivery or payment before acceptance.

We may reject or cancel before acceptance for stock unavailability, an obvious error, suspected fraud, legal or safety restriction, quantity limit or inability to deliver. If payment has been received for an order we do not accept, it will be returned through the approved method.

8. Price, taxes and payment

Prices are in the currency displayed. Before acceptance, the full price will include or separately identify applicable tax, transportation and any mandatory charge.

Payment must use a method approved in the order process. Never send us a full card number, card security code, online-banking password or one-time password by email or a general form.

The online payment gateway is currently disabled. Unless the Website is updated to state otherwise, an E-Market submission is an order enquiry and payment instructions, if any, are provided only after verification. The Privacy Policy and checkout disclosures must be reviewed before any online gateway is activated.

9. Delivery, cancellation, returns and refunds

Accepted physical-product orders are subject to the Shipping & Delivery Policy. Cancellation, return, replacement and refund requests are subject to the Refund & Return Policy, the order circumstances and non-excludable consumer rights.

A statement that an item is non-returnable does not exclude a remedy required by law for goods that are defective, unsafe, misdescribed or otherwise fail a statutory guarantee.

10. Intellectual property

The Website and its text, software, design, graphics, images, video, trademarks, data compilations and other materials are owned by or licensed to MediLink-Global unless stated otherwise.

You may view and print reasonable extracts for lawful personal or internal business reference. You may not copy, modify, republish, sell, distribute, frame, create derivative works from or commercially exploit Website material without written permission, except where law allows.

MediLink-Global names, logos, domains and marks may not be used in a way that suggests endorsement, partnership or authorisation without written permission.

11. User submissions

You retain rights in material you lawfully submit. You grant us a non-exclusive right to use, reproduce and share it only as reasonably necessary to respond, provide the requested service, meet legal duties and operate or protect the Website, subject to the Privacy Policy and confidentiality obligations.

Do not upload malicious, defamatory, unlawful, misleading or infringing material or unnecessary sensitive information. We may quarantine, remove or preserve material where reasonably necessary for security, legal compliance or investigation.

12. Privacy, cookies and electronic communications

We process personal data as explained in the Privacy Policy. By submitting an electronic request, you agree that service, transaction, security and legal communications may be sent electronically where permitted.

The Website may use essential and optional cookies as explained in the Privacy Policy or cookie controls. Third-party services have their own notices.

13. Third-party services and links

Third-party portals, websites, maps, couriers, payment services and resources are governed by their providers’ terms. A link is not a guarantee or endorsement. We are not responsible for third-party content or conduct outside our control, subject to applicable law.

14. Website availability and changes

We may maintain, update, secure, suspend or withdraw the Website or a feature. We do not guarantee uninterrupted or error-free availability. Back up information you are responsible for keeping.

We may correct content, pricing or technical errors and update these Terms by publishing a revised version and date. Changes do not retrospectively alter an accepted order unless law permits or the parties agree.

15. Warranties and liability

We use reasonable care in operating the Website, but general Website content is provided on an “as available” basis. Implied warranties are excluded only to the extent Malaysian law permits.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or loss of profit, revenue, opportunity, goodwill or data, arising solely from Website use.

Nothing in these Terms excludes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or a statutory, consumer or other right that cannot lawfully be excluded or limited.

For a business user, liability under an accepted product or service order may be further governed by the signed contract or order terms. For a consumer, mandatory Malaysian consumer protections prevail.

16. Indemnity for unlawful business use

If you use the Website for business purposes, you will be responsible for reasonable loss, liability and cost caused by your unlawful use, infringement, unauthorised submission or material breach of these Terms, to the extent permitted by law. This clause does not apply to the extent the loss was caused by MediLink-Global or cannot lawfully be allocated to you.

17. Events outside reasonable control

Neither party is responsible for delay or failure caused by an event outside reasonable control, except for accrued payment obligations and duties that cannot lawfully be excused. The affected party should take reasonable steps to reduce the impact and communicate a material delay.

18. Suspension and termination

We may restrict or terminate access where reasonably necessary for security, maintenance, legal compliance, investigation, non-payment under an applicable contract or material breach. Where appropriate, we will provide notice and an opportunity to remedy.

Termination does not affect accrued rights, accepted orders or provisions intended to continue, including confidentiality, intellectual property, liability and dispute clauses.

19. General legal terms

If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions continue. A delay in exercising a right is not a waiver.

You may not assign an accepted order or Website right without our written consent. We may assign to a group company or successor as part of a legitimate reorganisation or business transfer, subject to applicable rights and notice requirements.

These Terms and incorporated policies are the entire Website-use agreement, but they do not replace a signed customer, portal or service contract.

20. Governing law and disputes

Malaysian law governs these Terms. The parties should first try to resolve a complaint through the Contact Us process. Malaysian courts have jurisdiction, subject to any mandatory consumer forum, tribunal, law or agreed dispute procedure.
